What are the rates of your services?

Every case is unique, we strive to provide the best assistance to our clients at rates they can afford.  We disclose our fees during your first appointment once we have an understanding of what will be required in your case.  

There are fixed costs to filing for Bankruptcy, the Court charges $338 to file a Chapter 7 Bankruptcy and $313 to file a Chapter 13 Bankruptcy.  Additionally, there are costs for mandated credit counseling/credit education course and credit reports which generally total under $50.

What if my house is in foreclosure?

Both Chapter 7 and Chapter 13 Bankruptcy STOP a foreclosure sale.  Mr. Mirkes will explain the differences in detail with you during your free consultation, but the basic rule is as follows:

Chapter 7 Bankruptcy stops a foreclosure action for a very short period and for this reason is not generally seen as the best option if you have equity or wish to keep your home.  In a Chapter 7 Bankruptcy you would either need to bring payments current immediate or sell your home within a very tight timeframe.

Chapter 13 Bankruptcy case stops a foreclosure indefinitely depending on your particular circumstances.  While you will need to resume regular monthly payments upon filing, unpaid pre-filing arrears can be paid over a term of 3-5 years via your repayament Plan or can be resolve via the sale or refinance of your home during such timeframe.
